De Marco Lawyers recognizes that modern banking and financial service requires more than just lawyering. We make an investment at the outset with all clients to understand their businesses, their strategic objectives and what really matters to them. In this way, we build long-lasting relationships with our clients. We earn their trust by consistently demonstrating our understanding of their business needs.
A proportion of our work has an international presence and dimension. Rather than having overseas offices, we believe our clients are best served by working with top independent niche law firms in the overseas regions in which we operate.
Our practice has particular expertise in advising liquidators, directors, shareholders, creditors and debtors on complex corporate restructurings and insolvencies including personal bankruptcy. This advice also incorporates expertise in the areas of tax, real estate, litigation and superannuation.
Our Insolvency Team has strong relationships with key stakeholders like accountants, liquidators and restructuring experts as well as with investors and landlords. Our Team’s expertise is recognized for delivering innovative and practical solutions. A recent example is the recovery of a six-figure amount for creditors from the Australian Taxation Office in a contested liquidation dispute upon the basis of the preference rules under the Corporations Act.
Our lawyers have acted for insurance companies, agents and brokers and insureds for 40 years. This has included: advice, dispute resolution services, policy drafting and appearances before parliamentary committees enquiring into insurance law and regulation; as well as advice on risk management, risk financing and risk transfer in a wide variety of insurance areas ranging from home and contents, industrial special risk, agricultural product, marine and aviation, professional indemnity, public liability and directors & officers to credit default swap derivative and trade financing insurance. Our Team also has experience as the director of a major industry insurance broker.
Our Superannuation and Insurance Team also has experience in advising upon and enforcing superannuation insurance products such as life insurance and total permanent disablement policies. Our team is currently advising insureds in relation to disclosure issues involving pre-existing physical and mental conditions and their effect upon current and future claims entitlement.
