Principal - Dispute Resolution

Michael Tourkakes is the Principal of Dispute Resolution at De Marco Lawyers, where he leads a broad litigation and advisory practice spanning civil & commercial litigation, dispute resolution, insolvency, estate litigation, risk management and planning. With over ten years of experience acting for individuals, businesses, liquidators and trustees, Michael has built a reputation for delivering practical, strategic outcomes in high-stakes disputes. He is regularly instructed in complex Supreme and Federal Court proceedings and is known for his ability to cut through legal noise and focus on what matters commercially.


Michael’s work has been recognised industry-wide, with finalist nominations for Litigator of the Year (2023 and 2024), Dispute Resolution Partner of the Year (2023), and Insolvency & Restructuring Partner of the Year (2024) at the Lawyers Weekly Australian Law Awards. His matters often involve multi-party litigation, corporate deadlocks, debt recovery, unfair preference claims, and the enforcement of securities and judgments. He brings strong analytical skills to each matter, combining technical legal knowledge with a firm grasp of commercial realities.


Michael is also committed to the development of the profession. He mentors junior lawyers within the firm and frequently collaborates with barristers, accountants and industry professionals to deliver well-rounded advice. He has spoken at legal forums and CPD events on topics including bankruptcy, family law intersections with commercial litigation, and resolving property disputes through negotiation or litigation. His leadership style focuses on empowering younger practitioners and maintaining high professional standards within his team.


Outside of legal practice, Michael is a devoted husband and father. Samiksha graduated with a Bachelor of Laws (Honours) and Bachelor of Arts (Criminology) from Monash University in 2021, completed her Graduate Diploma in Legal Practice at Leo Cussen in 2021 and was admitted as an Australian Legal Practitioner by the Supreme Court of Victoria in February2022. 

 

Samiksha's interest in Commercial Law and Civil Litigation grew when she commenced working at De Marco Lawyers in April 2022. She has experience with retail and commercial leasing, mortgage agreement reviews, drafting trust deeds, building contract reviews and commercial litigation.

 

Samiksha also has experience with Litigation in the Supreme Court of Victoria, County Court of Victoria, Magistrates' Court and the Victorian Civil and Administrative Tribunal, having worked on matter relating to contract rescission, contract repudiation, common property damage, fencing disputes, leasing disputes and caveats.

 

Outside of work, Samiksha enjoys spending time with family and friends, and helping out at her local community.

Khadija Saad

Khadija is a dedicated Juris Doctor graduate from Monash University, passionate about making a meaningful impact in the legal field. In 2020, Khadija distinguished herself by winning the Muslim Legal Network long piece essay writing competition. Her thought-provoking essay, which explored the intersection of reproductive rights, international law, and compatibility with Islam, not only earned her a placement at a local law firm but also highlighted her ability to tackle nuanced and challenging topics.


Khadija's interest in international law was further solidified during her professional elective at university, where she authored a comprehensive essay on the effectiveness of the Convention on the Elimination of All Forms of Discrimination Against Women in combating femicide in Turkey. This important work received recognition when it was cited by the European Parliament in their report, "Preventing, Protecting, Providing Access to Justice: How Can States Respond to Femicide?" Khadija views this moment as a pivotal achievement in her career, reflecting her commitment to advocating for women's rights on a global scale.


With hands-on experience in settling commercial matters exceeding $20 million and successfully saving clients millions in damages, Khadija is carving out her niche in commercial, property and construction law. Her strategic mindset and meticulous attention to detail ensure that her clients receive the highest level of service and support.


Outside of her professional pursuits, Khadija values time spent with family and friends and enjoys immersing herself in literature.     Six years ago I was shocked to discover that I had been the subject of spurious charges of indecent assault and subsequently arrested, photographed and fingerprinted and was on remand which persisted for several years whilst the lengthy count process continued. I was also restricted to travel only within the state of Victoria and not permitted to visit my children and grandchildren who all live overseas.


    I had no idea what to do and was recommended by my accountant Mr. Maillard to consult Mr. Michael Pickering of deMarco’s Lawyers. He has continued to support me expertly and diligently over the five or so years of the extensive legal process including two mistrials which had occurred due to errors on the part of the prosecution lawyers which saw the jury discharged and trial set for a later date. All very stressful and I was most thankful for their ongoing support and care.


    Adding to my legal team were lawyer Ms. Khadija Saad and barrister Mr. Jacob Kantor. With their quite remarkable combined skills and persistence a favourable outcome was finally achieved with the jury finding me not guilty on all charges.


    Finally I was pleased that as a result of further application by Mr. Pickering and Ms. Saad to the Costs Appeal Board a large part of my legal costs due to the mistrial have been reimbursed.

Winnie Lam

Winnie is a Certified Practising Accountant (CPA) with over ten years of experience. She has also studied for a Master of Business Administration with a major in Financial Services.
 
Winnie is also admitted to practising as a lawyer. She worked with the Australian Taxation Office before joining De Marco Lawyers. She demonstrates a sound understanding of commercial requirements and the legislative, regulatory and compliance frameworks. Winnie has acquired a deep love of law. She always wants to find an opportunity to step out of her comfort zone. Her practice areas are comprised of Property Law including Conveyancing, Subdivisions, Off the Plan Developments, Adverse Possession, Mortgages and all areas of Commercial & Corporate Law.



Winnie has also volunteered as an immigration lawyer at the Refugee Legal Centre for four years. Winnie is a member of the Chinese Accountant Discussion Group Committee and the Emerging Leaders Network Committee with CPA Australia. She has also joined the Diversity and Inclusion Committee with Victorian Women Lawyers (VWL).

Winnie loves to play badminton and always learns something new in her spare time. Winnie also loves to meet people and make new friends. She enjoys attending social networking events.

Nicholas Lennon

Nicholas is a dedicated and diligent member of De Marco Lawyers' Commercial Law and Litigation team. Specialising in retail and commercial leases, Nicholas provides expert assistance in reviewing and drafting leases and resolving tenancy disputes.


Nicholas has developed a broad range of expertise in commercial law fields, including the sale and purchase of businesses, drafting of asset sale and shareholder agreements, and advising on guarantee and indemnity agreements. In the litigation sphere, Nicholas has gained valuable experience in VCAT and County Court proceedings, tenancy and co-owner disputes, intellectual property matters, and debt recovery actions.


Nicholas’ educational background includes a Bachelor of Arts (2018), a Graduate Certificate in Arts (2019), and a Juris Doctor (2022) from the University of Melbourne, followed by the completion of Practical Legal Training at the College of Law in 2023. This solid foundation has equipped him with the knowledge and skills to offer clients comprehensive, efficient, and strategic legal advice.

As a young lawyer, Nicholas is known for his attention to detail, strong work ethic, and commitment to achieving the best possible outcomes for his clients. Lin Wang

Lawyer

Lin is a versatile lawyer who provides advice to individuals and small business owners in a variety of industries. Her diverse practices include civil and commercial litigation, Wills and Estates, commercial law, joint venture disputes, loans and mortgages. Lin holds a Bachelor of Laws from the University of Adelaide and completed her Graduate Diploma in Legal Practice at Leo Cussen Centre for Law. Lin is admitted to the Supreme Court of Victoria and the High Court of Australia. 


Since working at De Marco Lawyers, Lin has successfully helped one of her clients to enter into a financially viable payment plan with the Australian Taxation Office (ATO) for an outstanding debt of more than $900,000.00. Lin has also represented clients in the County Court of Victoria, Supreme Court of Victoria and the Victorian Civil and Administrative Tribunal (VCAT). 


Lin is dedicated to helping clients navigate complex legal issues with her compassionate and personalized approach. Lin understands the importance of providing reliable advice and setting realistic expectations to clients. Lin is committed to social justice and believe that every individual has a right to legal representation. Lin also speaks fluent mandarin (simplified) and English.
