Administrative, Building & Construction
De Marco Lawyers appear regularly in the Victorian Civil and Administrative Tribunal and in the Administrative Appeals Tribunal. Our team has documented success in acting for parents seeking review of child support and payment orders and in reviewing decisions by Centrelink regarding suspension or cancellation of payments for aged pensions or for disability support pensions. De Marco Lawyers also appears in the Administrative Appeals Tribunal acting for taxpayers objecting to decisions by the F.I.R.B. and by the A.T.O. challenging administrative decisions dis-entitling deductions, refunds or carried forward losses or imposing penalties for the non-filing of income tax returns, income activity statements and business activity statements.
Recently, we acted for a leading photographic processing services client which claimed a large capital loss as a deduction against capital gains arising through a corporate reorganisation. The capital loss was disallowed by the Australian Taxation Office and the client appealed the disallowance to the Administrative Appeals Tribunal.
De Marco Lawyers also has extensive experience in appearing at VCAT in its Administrative Division, Civil Division, Human Rights Division and the Residential Tenancies Division.
Our VCAT team also acts for relatives and for persons who are the subject of compulsory mental health treatment orders.
Our VCAT team regularly acts for: developers, professionals and objectors before the Planning and Environment List of the Administrative Division; builders, a range of building professionals, insurers and developers relating to civil disputes in domestic building, owners’ corporations, retail tenancies and the sale and ownership of property; clients regarding issues arising from guardianship and administration and health and privacy information including a review of decisions made by the Mental Health Tribunal. Our VCAT team recently acted on behalf of a client whose considerable wealth had been placed into the hands of a professional trustee company pursuant to administration orders in circumstances where little benefit was being achieved for the client or for his relatives. De Marco Lawyers successfully replaced the original administration orders with a new order that the client’s affairs be placed into the hands of his preferred local accountant who provided a better service for a reduction of approximately 80% of the fees being charged by the professional trustee service.
Our building team has also acted in residential construction disputes over domestic building works for over a decade and has extensive knowledge and experience relating to claims for defective work, extensions of time, liquidated damages, rescission and repudiation of contracts, and claims for unpaid progress claims. Our VCAT team is highly experienced in the conduct of compulsory conferences and conciliations and mediations within VCAT in order to provide clients with cost effective beneficial solutions to their problems.
